关于间接正犯与纯正身份犯罪此种犯罪结构的关联性问题是刑法学理上在讨论纯正身份犯此一概念时常会讨论到的问题。本文基于间接正犯应是“正犯的间接”的基本观念,认为间接正犯的成立,必定以其前面有直接正犯为必要,故判断的重点则是非利用人必须具有纯正身分犯所要求的身分关系,而系被利用人是否具有纯正身份犯所要求的身份关系。本文系说明间接正犯的概念及种类,以及间接正犯的结构与纯正身份关系的关联性后,即综合上述的论述,分析有特定身份的人利用无特定身份、且主观上无故意的人和有特定身份的人利用有争议的情形应该如何评价的问题。
