《中华人民共和国民法总则》第十八条第二款沿用《民法通则》中的劳动成年制度,属于成年缓冲制度的一种,能够缓解纯形式化的年龄成年制的僵硬,具有独特的法律效果。但由于对“视为”法律拟制技术的认识分歧导致了该制度在理论分析中的瑕疵和在司法实践中的争议。为弥补这一缺陷,本文认为应当对其进行严格的司法解释予以改进。
The second part of Article 18 of the General Principles of Civil Law of the People’s Republic of China follows the adult system of labor in the General Principles of Civil Law and is a kind of adult buffer system that can ease the rigidity of the formal formal adult system and has unique legal effects . However, due to the disagreement on the “as” legal fictional technology, the flaws of the system in theoretical analysis and the disputes in judicial practice have been caused. In order to remedy this defect, this article thinks that it should be improved by strict judicial interpretation.
