农村经济作为社会主义市场经济的重要组成部分,对我国经济的发展起着重要的作用。农民个人信用贷款作为现阶段农民贷款的普遍方式,受农村个体经营风险较大等因素影响,很难取得充足的信贷资金。在这种情况下,受现行的法律、制度以及农村产权不明晰等现实因素的制约,农户的土地承包经营权、居民房屋权以及宅基地使用权等产权却没有充分发挥其作为抵押担保物的功能。因此,完善农村产权抵押担保贷款,对于解决我国农村融资难问题具有不可忽视的作用。本文从农村产权抵押担保贷款试点工作实施的背景引入,用理论和实践相结合的方法对我国现阶段抵押担保贷款的模式和存在问题进行探讨,最后提出完善农村产权抵押贷款制度的思路与对策。
As an important part of the socialist market economy, the rural economy plays an important role in the economic development of our country. As a common way of peasants ’loans, peasants’ personal credit loans are affected by the risks of individual businesses in rural areas and it is difficult to obtain enough credit funds. Under such circumstances, due to the current laws and regulations and the unclear property rights in rural areas, the real estate rights such as the land contractual management right, the residential property rights and the right to use house sites did not fully play their role as collateral Features. Therefore, perfecting rural mortgage-backed loans for property rights can not be ignored for solving the rural financing problems in our country. This paper introduces the background of the implementation of the pilot project of rural property right mortgage loan and discusses the mode and existing problems of the mortgage loan at the present stage in our country with the combination of theory and practice. Finally, it puts forward the ideas and countermeasures of improving the rural mortgage loan system.
