近年来,国际双边或区域自由贸易协定越来越多地嵌入环境条款,如何实现贸易政策与环境政策的融合开始成为各国关注的焦点。美国率先在自由贸易协定中加入环境条款,在寻求法理依据的同时,通过关联自由贸易协定和多边环境协议不断完善、强化环境条款,形成了有利于美国利益和国际环境话语权的条款范式与环境标准,已经在并将继续在诸多自由贸易协定中予以推广。为了与美国签署自由贸易协定,缔约国不得不根据美国的要求事先调整国内环境政策及法律。美国的这种做法将对全球环境治理格局和发展中国家环境体系带来深远影响,中国对此要有清醒认识。
