中国古代的基本思维方式就是直觉思维,这种直觉思维方式对宋代司法官的民事审判实践具有很深的影响。司法官员注重从当事人的言行举止等对其个人道德水平作出直觉判断,而以直觉断是非的思维方式与儒家传统的伦理常情是一致的。即使在法律有明文规定的情况下,司法官员在引据法条的同时,更注重的是这种以直觉断是非的思维方式的表达,从而使判决结果与民众对司法公平的期待相契合。
The basic way of thinking in ancient China is intuitive thinking. This way of intuition has a profound influence on the judicial practice of the civil courts in the Song Dynasty. Judicial officers pay attention to judging their personal moral level from their demeanor and deportment, etc. However, the intuition of right and wrong is consistent with the ethics of Confucian tradition. Even when there are express provisions in the law, judicial officials, while citing the law, pay more attention to this intuitionistic right-and-wrong way of thinking, so that the verdict matches the public’s expectation of fairness in the judiciary.
