我国2007年的《物权法》首次确立了浮动抵押制度,为中小企业提供了一种新的抵押贷款方式,具有重要的立法价值和现实意义。但是,浮动抵押制度也同时增加了我国商业银行的放贷风险,产生借款人骗贷逃债风险、操作风险、债权实现风险增加等一系列问题。文章从法律的视角,分析了银行放贷风险增加的主要法律原因,并在借鉴他国先进制度经验的基础上,从我国立法和商业银行自身的角度提出相应的完善措施。
China’s “Property Law” in 2007 for the first time established a floating mortgage system for SMEs to provide a new mortgage loan, has important legislative value and practical significance. However, the floating mortgage system also increases the risk of lending of commercial banks in our country, resulting in a series of problems such as borrowers fooling around with loans to evade debt, increasing operational risk and increasing the risk of claims. From the perspective of law, the article analyzes the main legal reasons for the increase of bank lending risk. Based on the experience of advanced countries in other countries, this article puts forward corresponding perfecting measures from the perspective of our country’s legislation and commercial banks.
