2008年1月1日,劳动合同法开始实施,新法实施前后的争论似乎一直都没有停止过。有人说,劳动合同法实施条例的颁布是为了更好地贯彻实施劳动合同法,也有平息争论的考量。劳动合同法实施一年来,关于劳动争议纠纷的案件较往年成倍地增长,新法的颁布在某种程度上刺激了劳动者为自己劳动权益进行维权的意识,同时也规范了用人单位依法用人的法律意识。2008年11月6日,在北京市法学会举办的劳动争议典型案例研讨会上,与会专家对案例进行了讨论。透过几起典型案例,我们或许可以看到新法对于劳资冲突双方的现实意义。
On January 1, 2008, the Labor Contract Law came into operation. The controversy before and after the implementation of the new law seems to have never stopped. Some people say that the promulgation of the Labor Contract Law promulgated in order to better implement the labor contract law, but also to pacify the debate. Over the past year since the implementation of the Labor Contract Law, the number of cases concerning disputes over labor disputes has doubled from previous years. The promulgation of the new law to some extent stimulated the workers ’awareness of safeguarding their labor rights and interests and standardized the employing units’ Legal Awareness. On November 6, 2008, at a seminar on typical cases of labor disputes held by the Beijing Municipal Law Society, the experts discussed the case. Through several typical cases, we may be able to see the practical significance of the new law on both sides of the labor dispute.
