现代意义上的品格证据规则创建于英国,是英美法系国家一项重要的证据法规则,其理论研究已相当成熟,立法也较为完善,如美国《联邦证据规则》第404条、澳大利亚1995年《证据法》第94条等。在司法实践中,正确运用品格证据不但有助于查明案件事实,而且能确保程序公正,对于推动司法进步有许多积极意义。
The rules of character evidence in the modern sense were established in Britain as an important law of evidence law in Anglo-American countries. The theoretical research is quite mature and the legislation is relatively perfect. For example, Article 404 of the Federal Rules of Federal Rules, the United States of America in 1995 Article 94 of the Law of Evidence and others. In judicial practice, the correct application of the evidence of character not only helps to find out the facts of the case, but also ensures that the procedure is fair and has many positive implications for promoting judicial progress.
