民事“执行难”一直是我国人民法院在执行民事裁决时面临的难题,也是社会关注的热点问题之一。大量的生效法律裁决得不到执行,不仅损害胜诉方的合法权益,也会影响我国的司法权威。确保生效法律裁判依法执行,是保障社会主义市场经济正常运行,维护社会稳定,促进社会和谐发展所不可或缺的重要条件。本文通过分析我国民事案件执行难的现状、产生原因及影响,结合我国在立法和司法实践,提出完善民事执行法律方面的解决途径,从而更好地保护债权人的合法权益,维护司法的公信力。
Civil “Enforcement is Difficult” has always been a challenge that our people’s courts face in implementing civil rulings. It is also one of the hot issues that the society is concerned about. A large number of effective legal rulings can not be implemented, which not only damages the lawful rights and interests of the winning parties but also affects the judicial authority of our country. Ensuring the effective execution of legal adjudication according to law is an indispensable and important condition for ensuring the normal operation of the socialist market economy, maintaining social stability and promoting harmonious social development. This article analyzes the current situation, causes and effects of the implementation of civil cases in our country, and puts forward the solutions to improve the law of civil enforcement in the light of the legislation and judicial practice in our country so as to better protect the legitimate rights and interests of creditors and safeguard the credibility of the judiciary.
