长期以来,我国实行以监禁刑为主的刑罚执行制度。随着经济社会发展和新形势下惩罚与预防犯罪要求的变化,迫切需要进一步改革完善我国现行刑罚执行制度。社区矫正制度的建立,促进了监禁刑执行和非监禁刑执行协调统一的新型刑罚执行体系的建立,是我国刑罚制度的重大改革,使我国刑罚执行制度进入了新的历史阶段。本文从健全社区矫正法律制度着手,结合社区矫正工作及法制工作的实践,对改革完善我国刑罚执行制度,进一步发挥司法行政刑罚执行职能作用提出若干思考。
For a long time, our country has implemented the penalty execution system that focuses on imprisonment. With the economic and social development and the changes of punishment and crime prevention requirements under the new situation, there is an urgent need to further reform and perfect the existing system of punishment in our country. The establishment of a community correction system has promoted the establishment of a new type of penalty execution system for the co-ordination of imprisonment execution and non-imprisonment execution. It is a major reform of the penalty system in our country, and the penalty execution system of our country has entered a new historical stage. Starting with the improvement of the legal system of community correction, combining with the practice of community correction and legal work, this article puts forward some thoughts on reforming and perfecting the implementation system of punishment in our country and further exerting the functions of judicial punishment.
