教学评估是实现有效教学的基础与保障。法学实践教学因其自身特殊性需要引入新的评估模式。对于法律诊所教育这一创新性法学实践教学形式,探讨其评估制度产生的社会背景、基本特征及内在矛盾,对解决我国传统法学教育评估体制之流弊、化解法学就业危机,推进以市场化、职业化为导向,以能力建设为中心的法学教育模式改革具有启示意义。本文以新制度经济学为视角,分析了影响诊所法律教学评估体系的三大动力机制,同时探讨了评估失灵的可能性。
Teaching evaluation is the basis and guarantee of effective teaching. Law practice teaching needs to introduce new evaluation mode because of its own particularity. The legal clinic education is an innovative teaching practice of jurisprudence. It discusses the social background, basic characteristics and inherent contradictions of the evaluation system. It is of great significance to solve the drawbacks of the traditional legal education evaluation system in our country, to resolve the legal employment crisis, It is instructive to reform the legal education model centered on capacity-building. In this paper, from the perspective of new institutional economics, this paper analyzes the three major driving forces that affect the assessment system of legal teaching in clinics, and discusses the possibility of failure of assessment.
