我国新的《破产法》已经出台,但是在金融机构破产这一问题上刻意留下了一道口子。这是因为金融机构破产具有不同于一般企业的特殊之处。本文从金融机构破产的含义、特殊性及必要性着手进行探讨,最后提出了加强金融机构破产法律监管的几条措施。
Our new “Bankruptcy Law” has been promulgated, but deliberately left a hole in the bankruptcy of financial institutions. This is because the bankruptcy of a financial institution is different from that of a general enterprise. This article discusses the meaning, particularity and necessity of bankruptcy of financial institutions, and finally puts forward several measures to strengthen the supervision of bankruptcy laws of financial institutions.
