世界经验表明,实行官员财产申报是建立透明政府﹑预防贪贿﹑遏制腐败的有效举措。然而,受多种因素、特别是既得利益者的阻挠,当下中国官员财产申报的呼声响彻于民间、失声于政府与胶着于高层官员的多次表态。文章试图在学理上从契合公共信息披露的精神、彰显现代法治的理念、体现公众知情权的保护、奠定社会和谐的基石、因应社会发展的历史境遇、表征成员国国际义务的履行等六个维度,进一步证实中国官员财产申报制度应该实行的正当理由,以期为这一“阳光法案”早日落定中华大地鼓与呼。 World experience shows that the implementation of official property declaration is an effective measure to establish a transparent government, prevent corruption and bribery and curb corruption. However, due to many factors, especially those with vested interests, the voice of the present Chinese officials declaring property has been heard in the private sector and stalled at many statements made by the government and top officials. The article attempts to theoretically demonstrate the modern concept of the rule of law, reflect the public’s right to information protection, establish the cornerstone of social harmony in accordance with the spirit of meeting the requirements of public information disclosure, and reflect the fulfillment of the international obligations of member states in response to the historical development of the society Further confirming the legitimate reasons why Chinese officials should declare the property declaration system so as to bring about an end to the vast land of China for this Sunshine Act as soon as possible.
