随着超市寄存柜顾客寄存物件丢失事件的不断发生,超市的自助寄存开始日益受到社会的关注和重视。而与超市寄存类似,宾馆酒店免费停车场中车辆的丢失等也开始成为民事纠纷的来源。如何界定这种因商事交易需要而附带的行为,众说纷纭。透过现象看本质,超市寄存行为其实是超市在贯彻利益最大化原则过程中,在和消费者进行商事经营活动中的附属商行为。本文指出从此角度出发来分析将更有益于纠纷的解决和问题症结的归属。
