要实现“新农村建设”的构想,中央应该完成三个方面的制度转变。首先,中央必须消除自身对农民和农村的制度性歧视;其次,中央必须逐步推进地方民主和法治,使地方问题主要在地方政府层次上获得满意的解决;最后,中央应该建立一套有效的法律规范审查制度,以此界定中央和地方的权限,制止地方保护主义以及对农民合法权益之侵害,充分落实农民的宪法和法律权利。要根治中国的“三农”问题,中央必须恢复农民的宪法平等地位,在制度上让农民“翻身”并允许他们通过制度维护自己的利益。
To realize the concept of “new countryside construction,” the central government should complete the institutional transformation in three aspects. First of all, the Central Government must eliminate its own institutional discrimination against peasants and rural areas. Second, the Central Government must gradually promote local democracy and the rule of law so that local problems are satisfactorily resolved at the local government level. Finally, the Central Government should establish an effective law Standardize the system of censorship in order to define the powers of the central and local authorities, stop local protectionism and infringe on the legitimate rights and interests of peasants, and fully implement the peasants’ constitutional and legal rights. In order to cure the “three rural issues” in China, the Central Government must restore the equal status of the peasants in the constitution, enable peasants to “turn over” the system and allow them to safeguard their own interests through the system.
