纵观当今时代,电子信息技术正在从多方位渗透进人们的生活,并改变着人们的生活方式。但正如科技是把双刃剑,电子信息技术也有其反面副作用,技术一旦被滥用,将会使人们的生活受到威胁,网络犯罪也由此产生。在网络犯罪中,电子证据作为一种维护人们权益的工具,其重要性日益突出。本文就非法证据排除规则在网络犯罪中的适用进行研究。 Throughout the modern era, electronic information technology is infiltrating into people’s life from many aspects and changing people’s life style. However, just as science and technology have double-edged sword and electronic information technology have their negative side effects, once the technology is abused, people’s lives will be threatened and cybercrime will be generated. In cybercrime, electronic evidence is increasingly important as a tool to safeguard people’s rights and interests. This article studies the application of the rule of illegal evidence exclusion in cybercrime.
