随着网络技术和盈利模式的逐步完善,视听产品贸易规则日益成为文化产品国际贸易关注的焦点。本文结合中美文化产品WTO一案裁决报告的分析,对互联网环境下视听产品市场准入的立法规制空间展开探讨。中国应争取国际规则的话语权,积极应对互联网市场开放中国家管理权面临的挑战,推进文化产品内容监管的立法建设。
With the gradual improvement of network technology and profit model, trade rules of audiovisual products have increasingly become the focus of international trade in cultural products. This article, based on the analysis of the report on the verdict of China-US Cultural Products WTO, explores the regulatory space for the market access of audiovisual products under the Internet environment. China should strive for the right to speak of international rules and actively respond to the challenges faced by China in opening up Internet markets to the Internet. China should also promote the legislative construction of cultural product content regulation.
