黑龙江省人民政府法制办公室:你办《关于城市房屋拆迁补偿有关问题的请示》(黑政法发[2004]14号)收悉。经研究,现答复如下:《城市房屋拆迁管理条例》第二条规定:“在城市规划区内国有土地上实施房屋拆迁,并需要对被拆迁人补偿、安置的,适用本条例”;第四条第二款规定:“本条例所称拆迁人,是指取得房屋拆迁许可证的单位”;第六条规定:“拆迁房屋的单位取得房屋拆迁许可证后,方可实施拆迁。”根
