文章认为土地承包经营权是一种用益物权,我国法律明确禁止以家庭承包方式取得的土地承包经营权抵押。十八届三中全会赋予农民对承包地进行抵押的权利,因此实践中出现了大量农村土地承包经营权抵押试点。土地承包经营权抵押的设立主要采用“抵押合同+登记”模式。为了避免农民的失地风险,实践中土地承包经营权的抵押贷款模式主要是“保证+土地承包经营权抵押”。目前,农村土地承包经营权抵押制度尚不成熟,需要政府的相关政策加以扶持。
The article holds that the land contractual management right is a usufructuary right, and the law of our country explicitly prohibits the mortgage of the land contractual management right obtained by the family contractual way. The Third Plenary Session of the 18th Central Committee gave peasants the right to mortgage the contracted land. Therefore, in practice, a large number of pilot projects for the mortgage of rural land contractual management rights have emerged. The establishment of the mortgage of land contractual management rights mainly adopts the mode of “mortgage contract + registration”. In order to avoid farmers’ risk of land loss, the practice of the land contractual management right of the mortgage loan model is mainly “guarantee + land contractual management right mortgage ”. At present, the mortgage system of rural land contractual management right is not yet mature and needs the support of relevant government policies.
