搜索引擎的出现给用户的网上航行提供了定位,导航的工具,但这项新技术也会被某些“聪明过头”的人迅速用于发不义之财。围绕关键词检索,现已出现了两类所谓“隐形商标侵权及不正当竞争纠纷”。通过关键词操纵搜索引擎查询结果的行为并不像“在一家店铺门前的马路上树立一块竞争对手的广告牌”那样简单,这分明是在处心积虑地妨碍用户与商标权人进行联系。所以一般来说,故意违规设置关键词或者出卖关键词广告,很可能构成商标侵权以及不正当竞争。
The advent of search engines has provided navigation and navigation tools for users’ online voyages, but the new technology is also quickly used by some “smarter” people for rogue purposes. So, in general, intentionally setting up a keyword or selling a keyword advertisement may constitute trademark infringement and unfair competition.
