人类社会已经由工业经济时代转变为知识经济时代,在这样的时代背景下知识产权的重要价值在得到完美彰显的同时。因为计算机技术和数字技术的飞速发展,使得知识产权也因此面临更加艰难的挑战,知识产权在人们心中的价值也因为网络信息和技术的开放化变得更加模糊。知识产权在面对这一重大问题中,也开始逐渐向公权化趋近。知识产权自身也因此具有了公权和私权两种权利,并且两种权利在知识产权中有互相协调的重要作用。
Human society has been transformed from an era of industrial economy to an era of knowledge economy. Under this background of times, the important value of intellectual property is perfectly demonstrated. Because of the rapid development of computer technology and digital technology, intellectual property is facing even more difficult challenges. The value of intellectual property in people’s minds is also blurred due to the opening up of network information and technology. In the face of this major issue, intellectual property rights have also begun to gradually move towards the reform of public ownership. As a result, intellectual property itself has both public and private rights, and the two rights play an important role in the coordination of intellectual property rights.
