各国在对待破产宣告的域外效力的问题上,主要适用的原则有属地主义原则和普及主义原则。①所谓属地主义原则是指一国破产宣告的效力只限于本国领土,只对位于本国境内的财产有效力,从而否认破产宣告的域外效力;普及主义原则是指承认一国破产宣告不仅在宣告国有效,在与该破产宣告有利害关系的其他国家也有效。
