通过对大陆法系主要国家的财产权制度的比较和分析,澄清了以物权为核心的大陆法系国家的财产权制度和英美财产法中财产制度的内涵、外延及其利弊。大陆法系财产权制度表现为物权和债权二元结构,分别调整物的静态占有和动态流转关系;英美法律系认为财产权是一组权利,是一个人对其所有的资源可能享有的各种权利。
Through the comparison and analysis of the system of property rights in major civil law countries, this paper clarifies the connotation, extension and advantages and disadvantages of the property rights system of civil law countries with real rights as the core and the property systems in the Anglo-American law of property. The system of property rights in continental law system shows the dual structure of real right and claim, adjusting the static possession and dynamic circulation respectively. The Anglo-American legal system holds that the property right is a group of rights and is a right that all individuals may enjoy for all their resources .
