法律不外乎人情,刑法的规定不能无视人类基本的情感和人性,这是刑法应有的情怀。然而审视我国现行刑法,体现着人类最基本情感的“亲亲相隐”制度在我国现行刑法中却没有相应的法律生存空间。本文在阐述了国外刑法对“亲亲相隐”的关照和“亲亲相隐”在我国刑法中规定的意义的基础上,对我国现行刑法提出了几点不成熟的立法完善建议。
Law is nothing more than human beings, criminal law can not ignore the basic human emotions and human nature, this is the criminal law should have the feelings. However, when examining the current criminal law in our country and embodying the most basic emotion of mankind, there is no corresponding space for legal existence in our current criminal law. This article elaborated the foreign criminal law to “the relative affection ” the care and “the kiss relatives hidden ” in the our country criminal law stipulated the significance, based on our country present criminal law put forward some immature legislation consummation Suggest.
