土地承包经营权与市场主体农民专业合作社二者的契合为实现农业产业化经营开辟了新的道路,但在实践中,出现了以家庭承包方式取得土地承包经营权不能入股流转、农民专业合作社对其入股的土地承包经营权不能自由转让、无权设定抵押、清算时不能将其作为债务承担等诸多法律障碍。承包权与经营权分离之后,农户仅以土地经营权入股,不会因为入股而失去土地承包权,这就为消除上述法律障碍提供了关键的制度基础。在承包权与经营权分离背景下,相关法律制度也应及时作出回应,为土地承包经营权入股农民专业合作社提供有效的制度保障。
The agreement of land contractual management right and farmer specialized cooperative market open up a new road for the realization of agricultural industrialized management. However, in practice, the contractual management of land can not be stocked by family contracting, and the right of farmer cooperatives The shares of the land contract and management rights can not be freely transferred, no right to set the mortgage, liquidation can not be used as a debt burden and many other legal obstacles. After the separation of contracting right and management right, the farmer households only take the land management right and will not lose the right of land contracting because of the shareholding. This provides the key institutional foundation for eliminating the above legal obstacles. In the context of the separation of contracting rights and management rights, relevant legal systems should also respond promptly to provide an effective system guarantee for farmers’ specialized cooperatives that land contractual management right.
