深圳市振业峦山谷小区是深圳市龙岗区的一个近万居民的大型小区,与该小区毗邻的比亚迪公司生产排出的废气直接影响到小区居民的生活和健康,同时在该地块上比亚迪公司斥资人民币80亿元正在兴建全球最大的磷酸锂电池厂。业主们大力反对该电池厂的建设,同时对比亚迪公司的废气污染也非常不满,在几经努力无果的情况下投诉到中华环保联合会。2011年9月本律师接受中华环保联合会的指派,为深圳市龙岗区振业峦山谷业主的环境维权提供法律援助。本律师介入代理后,通过多方寻找和收集证据、通过媒体曝光推动、采取合适的诉讼思路等途径,经过近8个月的努力成功地让该项目撤出了涉案地块,同时比亚迪公司对废气污染问题也给出解决的时间表。本文即是将本律师近8个月的代理思路加以梳理,并总结了几点代理中得到的启示。

After the lawyer involved in the agency, through multiple ways to find and collect evidence to promote through the media exposure to take appropriate litigation ideas and other means, after nearly eight months of efforts to successfully withdraw the project involved in the plot of land, while BYD company on the exhaust The issue of pollution also gives a timetable for resolution.
