2006年4月19日,国土资源部和国家工商行政管理总局在2000年10月发布的《国有土地使用权出让合同》示范文本基础上,联合发布了《国有土地使用权出让合同补充协议》示范文本(自7月1日起试行)。为何要制定出让合同示范文本?出让合同示范文本的框架和内容如何?如何理解2000年《出让合同》示范文本和2006年《补充协议》示范文本的有关政策精神?本刊特约两个合同示范文本的起草者,对这两个示范文本的总体内容和有关条款进行解读,以帮助读者更加准确地理解国有土地使用权出让合同的内容和政策精神,保护合同当事人的合法权益,规范土地出让行为。
On April 19, 2006, the Ministry of Land and Resources and the State Administration for Industry and Commerce jointly released the “Supplementary Agreement on the Contract for the Assignment of State-owned Land Use Rights” based on the model text of the “Contract for the Sale of State-owned Land Use Rights” promulgated in October 2000 Text (piloted on July 1). Why do we need to make a model contract for the transfer of the contract? How about the framework and contents of the model contract for the transfer contract? How to understand the spirit of the policy about the model contract of the “Contract of Assignment” in 2000 and the Model Text of the Supplementary Agreement of 2006? Of the drafters of the two model texts and the interpretation of the overall terms and articles to help readers more accurately understand the state-owned land use right transfer contract content and policy, protect the legitimate rights and interests of parties to the contract, standardize the land transfer.
