我国经济的发展带来城市规模的扩张,旧城区翻新改造速度加快。同时,拆迁矛盾也日益激烈,重庆市也不例外。在调查中可以发现,拆迁之所以矛盾重重原因有二:一是政府丧失了做为仲裁者的中立地位,二是土地所有权归属于国家,而政府收回土地使用权所凭借的“公共利益”无法做出明确界定。拆迁中,双方当事人任何一方的利益都不可能达到最大化,在这个利益冲突下,只有双方互相妥协,不断协调,拆迁才能进行。这就需要确立政府的中立地位,完善“非公推定”的公共利益评判原则,建立强制拆迁比例限制原则。在不改变土地国有的前提下,只有不断完善制度和程序,实现双方利益的平衡,才能确保拆迁的顺利进行,社会的和谐发展。

Without changing the state-owned land, only by constantly improving the systems and procedures and balancing the interests of both sides can we ensure the smooth progress of demolition and the harmonious social development.
