我国立法机关与西方议会作为代议机关在监督权职能的行使方面具有许多表象上的相似之处。但是,由于我国与西方各国在国体、政体等方面存在本质区别,从而导致了中西代议机关在监督权的行使与制度设计方面应当存在一些不同之处。西方议会行使监督权的有益经验对我国人大监督权的增强具有积极的借鉴意义,但并不具有照搬的作用,我们应该着重从我国立法机关的特有基础性理论出发,着重分析和重新审视我国立法机关职能的监督性因素,为此找到我国宪法实施监督模式的出路。
The legislature of our country and the Western Parliament as proxy agencies have many apparent similarities in the exercise of the powers of supervisory power. However, due to the essential differences between the state and the political system in our country and other western countries, there are some differences in the exercise of the supervisory power and the design of the system between the Chinese and the western representative bodies. The beneficial experience exercised by the Western Parliament in exercising its supervisory power has positive referential significance for the enhancement of the supervisory power of the NPC, but it does not have the effect of copying. We should focus on starting from the unique foundational theories of our legislature, and focus on analyzing and re-examining the legislation of our country The supervisory factors of the function of the organ, so as to find out the way of implementing the supervision mode of our country’s constitution.
