城市房屋拆迁问题是涉及到政府、房地产开发商及被拆迁人三者利益,影响社会稳定的一个重大问题。对城市房屋拆迁行为进行审批,这是整个城市房屋拆迁行为的第一环节。因此,房屋拆迁许可行为合法、公正与否直接决定拆迁工作能否顺利进行,被拆迁人的私有权利能否得到有效的保护。而目前我国城市房屋拆迁行政许可制度还不够完善,不利于保护被拆迁人的合法权益。因此,必须完善我国现行的城市房屋拆迁行政许可制度。
The issue of urban house demolition is a major issue that involves the interests of the government, real estate developers and the demolished people and affects social stability. Approval of urban housing demolition behavior, which is the first step in the entire urban housing demolition behavior. Therefore, the legalization and fairness of the permit for demolition of housing directly determine whether the demolition work can proceed smoothly and whether the private rights of the demolished can be effectively protected. At present, China's urban housing demolition administrative licensing system is still not perfect, is not conducive to the protection of the legitimate rights and interests of the demolition. Therefore, we must perfect our current urban housing demolition administrative licensing system.
