主办侦查员制度实施的宏观政策背景下,从侦查主体主观方面来看,导致侦查错案的因素主要是侦查主体的认知偏差,具体表现为启发式偏差、证据评估偏差、初始印象偏差。应对这些致错因素,需建立依据和结论的确实联系,明确证据的法律规定,强化侦查活动的目的意识,接受逻辑推理的训练。
Under the macro policy of implementing the investigator system, from the subjective aspect of investigating subjects, the main factors leading to the investigation of misjudged cases are mainly the cognitive bias of the investigating subjects, specifically heuristic bias, evidence evaluation bias and initial impression bias. To deal with these factors that cause errors, it is necessary to establish the true link between the basis and the conclusion, clarify the legal provisions of evidence, strengthen the purpose awareness of investigation activities and accept the training of logical reasoning.
