行政法解释在法律思维上的特殊之处就是,在遵循一般法解释学原理“解释学循环”的前提下,表现出一个法官的眼光在“事实—规范—政策”之间往返流盼的现象。原因即在于,在行政法解释过程中,法官不仅受到法律思维的标准正义观念的影响,而且还受到与行政活动密切联系的“政策”的作用。本文即要揭示政策进入司法对于行政法解释过程带来的实用主义影响。这种影响又可以在审查标准与解释方法两个层次得以铺展和表现,以求从法律思维的角度阐明行政法解释之特殊性。同时,“认真对待实用主义思维”也是一种非常重要的姿态:行政法解释需要在正义与政策之间以敏锐的审判智慧保持某种平衡,既认真对待其灵活与机巧,更认真对待其恣意与任性。
