中国企业近年来劳资冲突频发。2009年“通钢”事件、2010年东南沿海的停工潮和2011年在广东省的“西铁城”等罢工事件中,罢工事实上成为中国工人在许多时候要求与资方进行谈判不果时采取的极端措施。近年中国集体劳动争议导致的集体停工现象增加,小微企业劳资争议双方主体化和社会责任意识都不够强,用和大企业一样的方法来处理小微企业的劳动争议是不行的。
