转型时期的中国刑事司法及改革必须面对现代法治理念普及、社会结构两极分化、信息化与全球化时代来临所带来的压力。在社会结构断裂的背景下,一些普通的刑事案件由于当事人的身份背景等因素,经由媒体作用之后成为社会高度关注的“公案”。对此类案件的处理已经超越了案件本身,并视为是不同社会阶层之间的矛盾和冲突。全球化时代的来临从观念、制度与实践等不同的层面影响着中国的刑事司法改革;日益增多的国际刑事司法合作、协助实践对中国刑事司法制度提出了新的要求。
China’s criminal justice and reform in the transitional period must face the pressure brought about by the popularization of the modern concept of the rule of law, the polarization of social structure, the advent of informationization and the advent of globalization. In the context of the breakdown of the social structure, some ordinary criminal cases have become the “public case” of great concern to the society after the role of the media due to factors such as the identity background of the parties involved. The handling of such cases has gone beyond the case itself and is seen as a contradiction and conflict between different social strata. The advent of the era of globalization affects China’s criminal justice reform at different levels of concept, system and practice. The increasing number of international criminal justice cooperation has helped to put forward new requirements for the criminal justice system in China.
