法治认同的普遍缺失是当下我国法治建设的短板。大众媒介提供了交流协商的场域,有利于将法治意识植入社会活动主体的主观认知。本文以新闻评论为例,展现了大众媒介对法治认同的构建作用,即:认知维度上,促使法律知识向常识转化;身份维度上,唤起现代法治中的公民意识;利益维度上,搭建“法治保障公民利益”的心理图式;价值维度上,凸显法治价值的阐释框架。新闻评论为建构法治认同提供了现实进路,表现在:内容方面,评论以明辨是非、彰显价值为显性诉求;以建构意义为隐性诉求,具有较强的“符号权力”;表达方面,评论以理性论证保障意义的有效交换;作用机制方面,评论作为社会的反思性中介参与了公众的认知循环。
The general lack of recognition of the rule of law is the short board of law building in our country today. The mass media provides a venue for exchanges and consultations, which is conducive to implanting the awareness of the rule of law into the subjective cognition of the main body of social activities. This article takes the news commentary as an example to demonstrate the construction effect of the mass media on the recognition of the rule of law, that is: on the cognitive dimension, it promotes the transformation of legal knowledge to common sense; on the identity dimension, it arouses the citizen consciousness in the modern rule of law; on the benefit dimension, “The rule of law to protect the interests of citizens,” the psychological schema; value dimension, highlighting the interpretation of the value of the rule of law framework. The news commentary provides a realistic approach to the construction of the rule of law identity. The content is as follows: content, the comment distinguishes between right and wrong, highlighting the value as the explicit demands; constructs the meaning as the implicit appeal, has the stronger “symbolic power”; , The comment is an effective exchange of meanings for the protection of the rational argument. As for the mechanism of action, the comment participates in the public’s cognitive cycle as the reflective intermediary of the society.
