四、行政处罚的程序(一)行政处罚决定程序中的共同要件行政处罚法根据公正与效率兼顾的原则,在行政处罚的决定程序中规定了两种基本程序——简易程序和一般程序。在一般程序中对那些需要给予当事人较重的行政处罚的,还特别规定了听证程序。但不论按简易程序还是一般程序作出行政处罚决定,都有五个必须遵循的共同要件。这五个要件都是规范行政处罚实施单位和行政执法人员的,属于程序性义务。
IV. Procedures for Administrative Punishment (I) Common Elements in Administrative Penalty Determining Procedures The Administrative Penalty Law stipulates two basic procedures - summary procedure and general procedure - in the procedure for determining administrative punishment based on the principle of fairness and efficiency. In the general procedure for those who need to be given heavier administrative penalties, but also provides for hearing procedures. However, there are five common elements that must be followed, regardless of whether an administrative punishment decision is made by simple procedure or general procedure. These five elements all regulate the implementation of administrative penalties and administrative law enforcement personnel, and are procedural obligations.
