2007年,中国林权制度改革进一步深化。作为民法典的重要组成部分之一的物权法公布实施后,如何在物权法视野下认识中国的林权体系就成为一个问题。为此,本期共刊发三篇文章专门探讨上述问题。第一篇立足于现有的法律规定和实践经验,依据物权法原理,以“所有权-用益物权-担保物权”为主线,梳理出适当的林业物权体系。后两篇则分别对林地地役权和林业物权变动作了专题探讨。这些研究着眼于我国的法律经验,对我国目前的林权改革可以提供有益的理论支撑。
In 2007, the reform of China’s forest tenure system was further deepened. As one of the important parts of the civil code, when the Real Right Law is promulgated and implemented, how to understand China’s forest tenure system from the perspective of the Property Law becomes a problem. To this end, this issue a total of three articles specifically addressed the above issues. The first article based on the existing legal provisions and practical experience, based on the principle of property law, with “ownership - usufructuary rights - secured property rights ” as the main line, sort out the appropriate forestry property system. The latter two articles respectively discussed the changes of easements and forestry real estates in woodland. These studies focus on the legal experience of our country and can provide useful theoretical support for the current reform of forest tenure in our country.
