我国《物权法》和《农村土地承包法》对于土地承包经营权的公示方式没有做出明确的规定,只是将土地承包经营权合同确立为土地承包经营权设立的生效要件,以及规定了在其流转时,如不登记,则不具有对抗第三人的效力。这都与土地承包经营权的物权属性相矛盾,在现实中也造成了诸多问题。因此,随着我国立法的不断完善,土地承包经营权的日益市场化,在立法上应进一步完善土地承包经营权的公示方式,确立土地承包经营权登记公示制度,真正落实《中共中央关于推进农村改革发展若干重大问题的决定》,切实维护好最广大农民的根本利益,实现土地承包经营权的规范有序化。
