古籍点校作品的著作权法律问题不是著作权领域的常见问题,却是疑难问题。正因其疑难而卓显影响重大。分析并且处理好古籍点校作品的著作权,对于实践中的特殊类型作品的著作权司法保护具有指导意义。具有独创性是作品能够获得著作权保护的充分必要条件。独创性应从作品的表达中寻找判断。文章以一般作品独创性的判断标准为指引,从整理者对古籍作品整理体例的独创安排、考证、选取史实,以及进行独创的组合、编排而使得古籍能够恢复原貌并便于今天的读者阅读理解等方面分析了古籍点校作品的独创性。因此古籍点校作品构成了法律意义上的作品,具有可版权性并适用著作权法的保护。但这并不意味着所有的点校结果都受著作权法的保护,对古籍点校作品给予著作权保护,也并不意味着对古籍本身实施了著作权保护。在判断古籍点校作品的独创性时,必须坚持具体作品具体分析的基本思路。
The law of copyrights in the works of ancient books is not a common problem in the field of copyright, but it is a difficult one. It is because of its difficulties and significant impact. Analyzing and dealing with the copyright of the ancient books and school works is of guiding significance to the judicial protection of copyright in the special types of works in practice. Being original is the necessary and sufficient condition for the work to obtain copyright protection. Originality should seek judgment from the expression of works. The article takes the originality judgment criteria of general works as the guideline. From the arranger’s original arrangement, textual research, selection of historical facts and the original combination and arrangement of ancient works, the article can make the ancient books recover their original appearance and facilitate the reading comprehension of today’s readers. It analyzes the originality of the works of ancient point school. Therefore, the ancient point of school works constitute the legal sense of the work, with copyright and copyright law applicable to the protection. However, this does not mean that all the results of point schools are protected by the Copyright Law. Copyright protection of the works of ancient point schools is not meant to imply copyright protection for the ancient books themselves. In judging the originality of the works of ancient school points, we must insist on the concrete idea of concrete analysis of concrete works.
