作品、发明和商标作为知识产权的权利对象不仅外观形态上都表现为符号组合,而且本质上与符号的非物质性、整体性和任意性特征吻合。知识产权对象的共性是符号性。相应地,知识产权法价值原则的核心是权利对象所表现出的区别性。知识产权法在规则设计时关注的焦点也应从权利对象的创造性判断转变为权利对象的区别性判断。
The object of rights of works, inventions and trademarks as intellectual property not only appears as a combination of symbols in appearance, but also essentially conforms to the immaterial, integral and arbitrary characteristics of symbols. The commonalities of intellectual property objects are symbolic. Accordingly, the core of the principle of the value of intellectual property law is the distinction shown by the object of rights. The focus of intellectual property law in the design of rules should also shift from the creative judgment of the right object to the differential judgment of the right object.
