2005年11月在上海召开的央企国有产权交易试点机构工作协调会议上,各方对建立产权市场行业协会达成一致意见,即行业协会由国务院国资委产权局牵头,尽快成立筹备领导小组。而今年1月1日起正式实施的新《公司法》第139条规定：“股东转让其股份,应当在依法设立的证券交易场所进行或者按照国务院规定的其他方式进行。”为产权市场的发展创新留出了足够的法律空间。我们有理由相信,2006年将是产权市场发展的一个重要里程碑。
At the coordination meeting of pilot state-owned property rights trading institutions held in Shanghai in November 2005, all parties reached an agreement on establishing a property rights market association, that is, the trade association should be led by the SASAC’s property right bureau to set up a preparatory leading group as soon as possible. Article 139 of the new Company Law, which came into force on January 1 this year, stipulates: “The transfer of its shares by shareholders shall be conducted at a securities exchange place established in accordance with law or in accordance with other provisions prescribed by the State Council.” For the development of the property market Innovation leaves enough legal space. We have reason to believe that 2006 will be an important milestone in the development of the property market.
