在“一国两制四法域”下,中国区际商事仲裁裁决的认可与执行问题则日益突出。该文通过比较,探讨了中国区际商事仲裁及其裁决的界定、裁决的法域归属划分标准及其司法审查范围等问题。并主张在中国区际仲裁裁决的认可与执行中,取消互惠原则,严格限制公共秩序保留制度的使用;最后,针对中国区际仲裁存在的问题,提出了相应对策。 Under the principle of “one country, two systems and four jurisdictions,” the recognition and enforcement of China’s commercial arbitral awards have become increasingly prominent. The article discusses the definition of the interregional commercial arbitration and its ruling, the criteria for the classification of ruling jurisdictions and the scope of judicial review in China. And advocated the abolition of the principle of reciprocity in the approval and enforcement of China’s regional arbitral awards and the strict restriction of the use of the system of preserving the public order. Finally, some countermeasures were put forward in light of the problems existing in China’s regional arbitration.
