在我国招标采购领域一直存在最低评标价法和综合评估法孰优孰劣的争议。产生这些认识问题的一个重要原因是对于评标阶段的划分不够科学,导致各阶段的评审因素和标准不够明确。作者通过参照联合国采购示范法对评标阶段进行划分的方法,对现行法律规定进行梳理,指出最低评标价法和综合评估法都是对价格因素和非价格因素的综合考量,并建议从科学划分评标阶段的角度,消除社会公众和招标采购从业人员对于评标方法的认识误区,正确选择适用评标方法,取得更好的采购效益,并针对不正常低价投标提出了应对建议。
In the field of bidding and purchasing in our country, there is always controversy between the lowest evaluation method and the comprehensive evaluation method. An important reason for these problems of understanding is that the division of the bid evaluation stage is not scientific enough and the reviewing factors and standards of each stage are not clear enough.
