在刑事侦查中,面对犯罪嫌疑人的沉默权,警察讯问面临挑战。以国外沉默权对警察讯问的限制及其有限性为参照,结合我国实际,可知沉默权的确立将给我国警察讯问带来重大影响。我国亟需从侦查模式、警察技能、刑事技术、强制措施、检警关系、场所监督等方面对沉默权下的警察讯问制度加以规范。
In criminal investigation, facing the suspect’s right to silence, police interrogation faces challenges. Taking the limitations and the limitations of the foreign police’s right to silence as a reference for police interrogation and the reality of our country, we can see that the establishment of the right to silence will have a significant impact on our police interrogation. It is imperative for China to regulate the system of police interrogation under the right of silence from the aspects of investigation mode, police skills, criminal technology, coercive measures, the relationship between police and prosecutors, and the supervision of places.
