“走出去”是我国企业参与国际市场竞争、走向国际市场的必然选择。但海外知识产权风险频发也是企业不得不面对的现实。随着我国企业逐步走向国际化,我国企业有必要建立知识产权风险评估机制,以有效规避知识产权风险。本文通过分析海外知识产权风险类型和原因,提出我国企业构建知识产权风险评估机制的组织结构图和内容,以期为我国企业应对海外知识产权风险提供参考。
“Going out ” is the inevitable choice for Chinese enterprises to participate in the international market competition and go to the international market. However, the frequent occurrence of overseas intellectual property risks is also the reality that enterprises have to face. With the gradual internationalization of our country’s enterprises, it is necessary for Chinese enterprises to set up a risk assessment mechanism of intellectual property to effectively circumvent the risks of intellectual property. This paper analyzes the types and causes of overseas intellectual property risk, and puts forward the organizational chart and content of our country’s enterprises to establish intellectual property risk assessment mechanism in order to provide reference for Chinese enterprises to deal with overseas intellectual property risk.
