耕地生态补偿是生态扶贫的重要方式,生态扶贫旨在实现不同层次生态系统服务的可持续供给,力求找到生态环境保护与社会、经济发展之间的平衡点,且该目标实现要求依托科学合理的耕地生态补偿法律制度。而法政策学探讨在设计法律制度时如何兼顾效率和正义,恰为法律制度设计提供了方法论。本文在对生态扶贫与耕地生态补偿研究及实践进展回顾的基础上,系统分析两者的协同关系,论证生态扶贫协同下耕地生态补偿法律制度完善的必要性。基于法政策学视角,剖析生态扶贫与耕地生态补偿法律制度统合的维度与限度,依据“制度目标—制度工具—制度模式—制度基准”逻辑进路探寻耕地生态补偿法律制度完善的路径,以实现制度构建体系化目标。
Ecological compensation of cultivated land is an important way for ecological poverty alleviation.
