医疗事故的鉴定一般由患者一方向当地卫生行政部门提出申请 ,卫生行政部门经过审查 ,认为有必要鉴定的才由卫生行政部门指派医疗事故技术鉴定委员会作出鉴定。卫生行政部门根据医疗事故技术鉴定委员会作出的鉴定结论进行调解。
