根据《中华人民共和国劳动法》规定的劳动争议的仲裁程序,是诉讼程序的前置程序。所谓前置程序指劳动争议的仲裁程序是诉讼程序提起的必须的前提程序,劳动争议如果未经仲裁程序的仲裁裁决,当事人不得向人民法院提起诉讼,当事人未经仲裁程序而直接向人民法院起诉,人民法院不得受理。但作为处理劳动争议仲裁程序规定的《中华人民共和国企业劳动争议处理条例》却没有规定反申诉,这在程序上违反平等、对等原则。劳动关系的当事人对仲裁裁决不服,可以向人民法院提起诉讼。当一方当事人起诉,根据《中华人民共和国民事诉讼法》的规定,另一方当事人可以反诉,但其反诉权能否实现?而当双方当事人均不服仲裁裁决,向人民法院起诉,当事人一方可否反诉?

When both parties refuse to accept the arbitral award and sue the people’s court, can one of the parties counterclaim?
