我国2008年实施的《中华人民共和国政府信息公开条例》(以下简称《条例》)第十四条规定:行政机关不得公开涉及国家秘密、商业秘密、个人隐私的政府信息。但是,经权利人同意公开或者行政机关认为不公开可能对公共利益造成重大影响的涉及商业秘密、个人隐私的政府信息,可以予以公开。本条旨在保障公民知情权的同时保护公民的隐私权,但由于法条规定的不明确,导致《条例》在实际运用的过程中产生了政府公开信息侵犯公民隐私全和以保护公民隐私全的名义不公开政府信息等问题。因此,必须明晰政府信息公开过程中公民隐私权和公共利益的界定,增强《条例》的可操作性,完善我国政府信息公开制度。
