相比GATT,WTO争端解决机制得到了进一步的强化。为了评价新的争端解决机制在“以规则为导向”的道路上已经走了多远,以及在一定程度上预测其未来能走多远,本文主要运用国际关系理论对WTO裁决的遵守原理进行系统分析。文章内容主要涉及两个层面:第一个层面,以相关的国际法遵守理论为分析工具,结合具体案例,探究影响WTO裁决遵守的一般性因素;第二个层面,指出当前部分国际法学者和发展中国家所提出的有关促进WTO裁决遵守的措施在政治上的限度,并论证了其他可行措施。
Compared with GATT, WTO dispute settlement mechanism has been further strengthened. In order to evaluate how far the new dispute settlement mechanism has been on the path of “rule-oriented” and to a certain extent predict how far it can go in the future, this paper mainly applies the principle of observing WTO ruling according to the theory of international relations Systematic analysis. The content of the article mainly involves two levels: On the first level, with the related theory of compliance with international law as the analysis tool, combined with specific cases, explore the general factors that affect the compliance of WTO ruling; the second level, point out that some current international law scholars and developing The political limits imposed by the State on measures to promote compliance with WTO rulings and the demonstration of other viable measures.
